Terms of Service

These Terms of Service govern your access to and use of www.iforgetalot.com and any related websites, applications, mobile applications, AI features, and other services provided by JStar Tech LLC, a California limited liability company ("JStar Tech," "we," "our," or "us"), including but not limited to the IFORGETALOT application and all successor versions, products, and services (collectively, the "Service"). These Terms of Service are a legally binding contract between you and JStar Tech regarding your use of the Service.

BY CLICKING "I ACCEPT," OR BY DOWNLOADING, INSTALLING, ACCESSING, OR USING THE SERVICE, YOU AGREE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY (TOGETHER, THESE "TERMS"). IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT USE THE SERVICE.

ARBITRATION NOTICE: EXCEPT FOR CERTAIN DISPUTES DESCRIBED IN SECTION 19, YOU AGREE THAT DISPUTES ARISING UNDER THESE TERMS WILL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION, AND BY ACCEPTING THESE TERMS, YOU AND JSTAR TECH EACH WAIVE THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING.

1. IFORGETALOT Service Overview

IFORGETALOT is a productivity software service that may allow users to organize tasks, set goals, manage schedules and calendars, create reminders and alerts, track productivity activity and completion, receive AI-generated productivity recommendations and insights, and optionally share selected progress information with other users for accountability, support, or collaboration purposes. Features and functionality of the Service may change over time.

2. Eligibility

You must be at least 13 years old to use the Service. Users between 13 and 17 must have verifiable consent from a parent or legal guardian who agrees to these Terms on their behalf and who maintains responsibility for the account. The Service is not available to children under 13. By agreeing to these Terms, you represent and warrant that: (a) you are at least 13 years old, and if under 18, your parent or legal guardian has agreed to these Terms on your behalf; (b) you have not previously been suspended or removed from the Service; and (c) your registration and use of the Service complies with all applicable laws and regulations.

3. Accounts and Registration

To access certain features of the Service, you must register for an account. You agree that the information you provide is accurate and complete and that you will keep it current. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. General Payment Terms

Certain features of the Service may require payment of fees. Before you pay any fees, you will have an opportunity to review and accept the fees that you will be charged. Except as otherwise expressly stated and except as required by applicable law, all fees are non-refundable. JStar Tech reserves the right to determine pricing for the Service.

The Service may include automatically recurring payments for periodic charges ("Subscription Service"). If you activate a Subscription Service, you authorize us and our third-party payment processors to periodically charge all accrued sums until cancellation. Your subscription will continue unless and until you cancel or we terminate it. If you subscribed through the Apple App Store or Google Play, billing, cancellation, and refund procedures may also be governed by that platform's rules.

5. IFORGETALOT Service Features

5.1 Free and Paid Features

The Service may offer both free and paid features or tiers. We do not represent or guarantee when, if ever, features available in a paid tier will become available in a free tier.

5.2 Shared and Accountability Features

The Service may allow you to share selected content with other users that you authorize. You understand that any user with whom you choose to share information may view, use, comment on, or respond to the information you choose to share. Those users are independent third parties and JStar Tech is not responsible for their conduct.

5.3 Reminders, Alerts, and Calendar Features

The Service may provide reminders, notifications, scheduling suggestions, and calendar-related functionality. Reminders, alerts, and notifications may be delayed, missed, unavailable, or inaccurate for various reasons. You remain solely responsible for your own deadlines, appointments, obligations, safety, and decisions.

5.4 AI Features

Certain features of the Service may use artificial intelligence. You acknowledge that: (a) AI-generated outputs are produced algorithmically and may not be reviewed by a human; (b) outputs may be inaccurate, incomplete, outdated, misleading, or inappropriate; (c) outputs are provided for informational and productivity-support purposes only; (d) outputs are not instructions, guarantees, or professional advice; (e) you must independently review and verify all outputs before relying on them; and (f) JStar Tech is not responsible for any output generated by AI Features.

5.5 No Professional Advice; No Emergency Use

The Service does not provide medical, mental health, therapeutic, counseling, legal, financial, employment, tax, safety, or other professional advice. The Service is not a crisis-response service and must not be used in any emergency or high-risk situation. If you are experiencing a medical emergency, mental health crisis, or thoughts of self-harm, contact emergency services or 988 immediately.

5.6 Beta Services

We may provide access to beta, pilot, or pre-release features ("Beta Services"). Beta Services may be incomplete, contain bugs, and may be modified or discontinued at any time. You use Beta Services at your own risk.

5.7 Text Message and Voice Call Escalation

You may choose to have the Service escalate a reminder by text message (SMS) or by automated voice call. These channels are off by default and operate only after you provide and verify a mobile telephone number and expressly consent to the specific channel. Consent to text messages is separate from consent to voice calls, and neither is a condition of creating an account, of any purchase, or of using any other part of the Service. Message frequency varies with the number of reminders you create and the importance level you assign to them. Message and data rates may apply. Reply STOP to cancel text messages or HELP for help; you may also turn either channel off at any time in the Service's notification settings. Delivery depends on your wireless carrier, network conditions, and device settings, and neither JStar Tech nor any wireless carrier is liable for delayed or undelivered messages or calls. These channels are subject to Section 5.5 and must not be relied on in an emergency.

6. Licenses

Subject to your compliance with these Terms, JStar Tech grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal use. You may not reproduce, distribute, modify, reverse engineer, or create derivative works of the Service except as permitted by law.

If you provide suggestions, ideas, or feedback ("Feedback"), you grant JStar Tech an unrestricted, perpetual, irrevocable, royalty-free right to use such Feedback in any manner without compensation or attribution.

7. Ownership; Proprietary Rights

The Service, including its visual interfaces, graphics, design, software, code, AI systems, and all other elements, is owned by JStar Tech and protected by intellectual property and other laws.

8. Third-Party Terms

The Service may contain links to third-party websites, services, or integrations. JStar Tech is not responsible for any third-party services, including their availability, accuracy, privacy practices, or content.

8.1 Gmail Integration

If you choose to connect a Gmail account, you authorize iForgetalot to access the contents of your Gmail inbox via Google's OAuth flow for the sole purpose of suggesting task entries from incoming emails. Your authorization is required and revocable: you may disconnect the integration at any time from within the app, and you may also revoke our access from your Google Account's security page at any time. Use of Google Workspace data is subject to the Google API Services User Data Policy, and our handling of that data is governed by the iForgetalot Privacy Policy.

You retain all rights to your email content. We do not send, modify, or delete email on your behalf, and we do not use Gmail data to serve advertising or to train any model. We are not responsible for outages, errors, or changes in the availability of Google's services that affect this integration.

9. User Content

You retain any rights you may have in your User Content, subject to the rights granted in these Terms. By providing User Content, you grant JStar Tech a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, adapt, modify, display, and distribute your User Content solely as reasonably necessary to operate, provide, maintain, secure, support, and improve the Service.

You are solely responsible for your User Content and represent that you own or have all necessary rights to provide it and that it will not violate any law or third-party rights.

10. Communications

You may receive push notifications, reminders, alerts, and other in-app messages. You can manage notification preferences in the Service or through your device settings. We may send you transactional, administrative, and promotional emails. You may opt out of promotional emails. If you opt in, you may also receive text messages and automated voice calls as described in Section 5.7. You may opt out of those channels at any time without affecting your account.

11. Prohibited Conduct

You agree not to: use the Service for any illegal purpose; harass, threaten, or harm any other user; encourage self-harm, violence, or dangerous conduct; upload malicious code; reverse engineer the Service; impersonate any person; collect personal information without consent; send spam; use AI Features to generate unlawful or harmful content; or rely on AI outputs as professional advice.

12. Digital Millennium Copyright Act

We comply with the DMCA. If you believe material available on the Service infringes your copyright, you may submit a notification to our designated agent at JStar Tech LLC. We reserve the right to terminate the accounts of repeat infringers.

13. Modification of These Terms

We reserve the right to change these Terms at any time. If a change materially modifies your rights or obligations, we may require that you accept the modified Terms in order to continue using the Service.

14. Term, Termination, and Modification of the Service

These Terms are effective when you first accept them and continue until terminated. If you violate any provision, your authorization automatically terminates. JStar Tech may terminate your account at any time. You may terminate your account by following the instructions in the Service. JStar Tech reserves the right to modify, suspend, or discontinue the Service at any time.

15. Indemnity

You agree to defend, indemnify, and hold harmless JStar Tech and its officers, directors, employees, contractors, and affiliates from and against every claim arising out of your use of the Service, violation of these Terms, your User Content, your use of AI outputs, your interactions with other users, or your violation of any third-party right.

16. Disclaimers; No Warranties

THE SERVICE AND ALL MATERIALS, CONTENT, AI OUTPUTS, REMINDERS, NOTIFICATIONS, CALENDAR FEATURES, AND OTHER FUNCTIONALITY ARE PROVIDED "AS IS" AND "AS AVAILABLE." JSTAR TECH DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. JSTAR TECH DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT ANY REMINDER OR NOTIFICATION WILL BE DELIVERED OR ACCURATE; THAT ANY AI OUTPUT WILL BE ACCURATE, SAFE, OR SUITABLE; OR THAT USE OF THE SERVICE WILL IMPROVE YOUR PRODUCTIVITY OR OUTCOMES.

17. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL JSTAR TECH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. THE AGGREGATE LIABILITY OF JSTAR TECH FOR ALL CLAIMS ARISING OUT OF THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO JSTAR TECH IN THE 12 MONTHS BEFORE THE EVENT; OR (B) $100.

18. Dispute Resolution and Arbitration

You and JStar Tech agree that disputes arising under these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You and JStar Tech each waive the right to a trial by jury and to participate in any class action. You may opt out of arbitration within 30 days after first agreeing to these Terms by sending written notice via certified mail. Arbitration will be conducted in Los Angeles County, California. For disputes not subject to arbitration, you agree to the exclusive jurisdiction of state and federal courts in Los Angeles County, California.

19. Miscellaneous

These Terms, together with the Privacy Policy, are the entire and exclusive understanding between you and JStar Tech. These Terms are governed by the laws of the State of California. You consent to receive communications from us electronically. By using the Service, you agree that all notices and communications we provide electronically satisfy any legal requirement that such communications be in writing.
